Stein Adler Secures Cancellation of Improper Notice of Pendency That Threatened Brooklyn Condominium Sales

Stein Adler recently secured an important win for the owner of a Brooklyn condominium development by obtaining the cancellation of an improperly filed Notice of Pendency (lis pendens) that threatened our client’s ability to market and sell condominium units.

The underlying lawsuit involved allegations of a below-grade encroachment and trespass by a neighboring property owner. Although the claims did not seek to affect title or possession of the property, the plaintiff filed a Notice of Pendency that created a cloud on title.

Partner Jacob E. Lewin and Law Clerk Amanda Quintana successfully demonstrated that the Notice of Pendency was legally improper because the lawsuit did not seek any judgment affecting ownership, title, or possession of the property. The Supreme Court, Kings County agreed and ordered the Notice of Pendency canceled, restoring our client’s ability to sell its condominium units.
